HELENA, Mont. -

A panel of federal judges says its order on the misconduct investigation into U.S. District Judge Richard Cebull is moot because the judge resigned.

The 9th U.S. Circuit Court of Appeals' Judicial Council issued an order March 15 following an investigation into Cebull forwarding a racist email involving President Barack Obama.

But the panel withheld releasing to the public the order and accompanying memorandum on the investigation.

Chief Judge Alex Kozinski first said there would be no statement until after Cebull's May 3 resignation. On May 3, Kozinski released another statement saying the council would review the matter on June 28.

Late Monday, the panel said its March 15 order on the misconduct probe was moot because Cebull resigned. The panel will consider revisions at its June meeting.
