LIVINGSTON, Mont. -

A Livingston man who was investigated in a poaching case is suing the state Department of Fish, Wildlife and Parks because he said the agency seized a photo album during the investigation and returned it without two sentimental photos.

Thomas Karnatz filed the lawsuit in Park County District Court in the summer of 2013 seeking return of the photos of his now-adult daughter catching her first fish when she was 2 and another of now-deceased hunting buddies.

When mediation failed last month to return the photos and an antelope mount confiscated during the May 2011 search of his house, Karnatz amended the suit and is seeking $1 million in damages.

FWP attorney Jack Lynch says "every photo lawfully seized was returned to the plaintiff."
