MISSOULA, Mont. - A Missoula man who's in prison for driving the getaway car in a shooting is appealing his case with the Montana Supreme Court.
In June, a judge sentenced Preston James Hanna to 20 years in prison for driving a friend who's accused of shooting and almost killing a store clerk.
Prosecutors say his friend Christopher Lee Burch went into Ole's in East Missoula to steal beer, but shot employee Adam Gallegos before running out to the car. Hanna drove away leaving Gallegos for dead.
In August, Hanna filed his notice of appeal but recently asked the Montana Supreme Court for an extension. He has until mid-December to file a brief explaining why his case should be appealed.
