MISSOULA, Mont. - The family of Washington state man killed by a Montana driver has sued the bar where the driver was drinking before getting behind the wheel.
NBC Montana told you when Brian Holm got into his car drunk and ran over Brian Beaver.
Investigators said Holm not only drank at KT's Hayloft Saloon in Lolo, but also got a to-go cup of whiskey before driving drunk in November 2010. He drove his car from KT's, into Missoula down Brooks Street and ran over and killed 24-year-old Beaver.
Holm was convicted of vehicular homicide under the influence and sentenced to 30 years in prison with 15 suspended last year. But he has yet to serve a day after a lengthy appeal process.
Now, Beaver's family is going after KT's alleging the bar over-served Holm.
NBC Montana talked to Brian Beaver's sister Teesha on Skype Monday. She said the family wants justice.
"It would be nice to have him behind bars, where he belongs," said Beaver. "So our family can put that part of it in the past and move on more so than what we've been able to do so far."
The lawsuit says Holm drank a pitcher of beer, and other alcoholic drinks, and asked for and was provided with a to-go cup before leaving the bar.
In court documents filed exactly two years after Brian Beaver's death attorneys asked for a jury trial.
