BOISE, Idaho -

An Idaho legislator may lose his concealed weapons permit because a sheriff says the Republican failed to disclose his 1974 guilty plea in a rape case.

The Idaho Statesman (http://tinyurl.com/lvkpzsl) reported Sunday Rep. Mark Patterson of Boise, now 61, was charged with rape in 1974.

He pleaded guilty to lesser charge of assault with intent to commit rape, getting a withheld judgment and probation.

Patterson now contends he didn't commit any crimes, but pleaded guilty on his attorney's advice.

He received a concealed weapons permit in Ada County in 2007.

Ada County Sheriff Gary Raney, who says he was tipped off to Patterson's Florida record earlier this year, says he revoked the permit last month because the first-term lawmaker didn't disclose the withheld judgment.

Patterson says he's mulling an appeal.
