Homeless man gets 40 years in Butte beating death

A transient who pleaded guilty to beating an Anaconda man to death for sleeping in his spot at a homeless camp in Butte has been sentenced to 40 years in prison.
36-year-old Shane Hans was sentenced Wednesday for mitigated deliberate homicide in the October 2011 death of 32-year-old Teddy James Hildebrant.
Public defender Steven Scott asked that his client be sentenced to the Montana State Hospital in Warm Springs. Scott presented expert testimony that showed Hans had a history of mental problems brought on by physical abuse. He said Hans also suffered severe head trauma after a car he was in was struck by a train when he was 12.
Prosecutors countered that methamphetamine and alcohol fueled Hans' rage the night of the attack.
