Defense in Sherry Arnold case seeks police files

HELENA, Mont. -

A man accused of killing a Sidney High School teacher wants state prosecutors to turn over the personnel files of the law-enforcement officers who investigated the case.
Michael Keith Spell's attorney says Spell has a right to the information and it might cast doubt on officers' credibility.
Deputy Richland County Attorney T.R. Halvorson responded to defense attorney Al Avignone's April 30 request on Monday.
Halvorson asked District Judge Richard Simonton to deny the request because Avignone has not shown the files are relevant and the officers are entitled to a right to privacy.
Simonton has not ruled on the request.
Spell and Lester Van Waters, Jr., have pleaded not guilty to charges of deliberate homicide and attempted kidnapping in the January 2012 slaying of Sherry Arnold, a popular math teacher.
