BOZEMAN, Mont. -

A Bozeman man is in jail after police said he assaulted an officer Wednesday night.

According to charging documents, 35-year-old James Sean Jimenez was confrontational with officers and refused to cooperate when they tried to pat search him.

He was a passenger in a car that police pulled over on suspicion of drunk driving.

After refusing the search, police grabbed Jimenez's arms, but say he was able to break free and aggressively grab Officer Michael Bachich's testicles.

The police report states he continued to grab the officer's testicles and wouldn't let go, until Officer Bachich hit him in the face.

Police say Jimenez then resisted being handcuffed, and tried to spit on other officers while they arrested him.

Jimenez is in jail on a felony charge of Assault on a Peace Officer, and is being held without bond.

A citizen originally called in the drunk driving report, after spotting Jimenez and the car's driver drinking in the McDonald's parking lot on Main Street, and driving off just before 10:45 pm.

Officers stopped the car near Cottonwood and Durston several minutes later.

The driver of the car, 20-year-old Nicholas Shields, was arrested for DUI and later bonded out of jail.
