A 23-year-old Billings woman sentenced to 20 years in prison with five years suspended for causing severe and disabling head injuries to an 8-month-old boy in her care is appealing her conviction.
The Billings Gazette reports (http://bit.ly/UAerth) that an attorney for Nevada Ugalde recently filed the appeal seeking a new trial.
The attorney says Ugalde didn't receive a fair trial due to misconduct by the prosecution and poor representation by her court-appointed attorney.
Ugalde was convicted in April 2010 of aggravated assault while baby-sitting 8-month-old Isaiah Napier in June 2008. She denied hurting the boy and told jurors she found him on the floor near the crib where he had been napping.
Ugalde was also ordered to pay $1.4 million in restitution because the child suffered permanent and disabling injuries.
