A settlement for the civil suit between an uptown apartment building owner in Butte and the ARCO Company could not be reached.
Judge Loren Tucker temporarily suspended the trial on Thursday so that attorneys could meet and negotiate a possible settlement.
It was announced Friday morning in court that a settlement was not possible at this time.
The owner of the uptown apartment building filed the lawsuit in 2003 claiming surface subsidence from past underground mining damaged the building.
The trial is scheduled to continue next week.
