Prosecutors in Yellowstone County are asking a judge to revive rape charges against a former Billings Senior High School teacher.
Prosecutor Rod Souza says Stacey Dean Rambold violated the terms of a deferred prosecution agreement when he was kicked out of a sex offender treatment program.
Prosecutors charged Rambold with three counts of felony sexual intercourse without consent in 2008. The alleged victim later committed suicide, and prosecutors said they wouldn't likely get a conviction without her testimony. Rambold and prosecutors eventually reached a deferred prosecution agreement in 2010, which called for dismissing the case in three years if Rambold met several conditions - including a requirement that he complete a sex offender treatment program.
Souza is asking the judge to schedule a trial.
