Man charged after struck pedestrian dies
SILVER BOW COUNTY
A Butte man has been charged with felony vehicular homicide while under the influence after an 80-year-old pedestrian died three weeks after being struck by a pickup truck.
Jack Lean was charged with the more serious crime in district court Tuesday after being initially charged with negligent vehicular assault.
Lean is accused of hitting Thomas Kelly on March 3 as Kelly was walking in a crosswalk. Kelly died in a hospital March 21.
Court documents say Lean had a blood-alcohol content of .129. The legal limit to drive is .08.
The Montana Standard reports (http://bit.ly/16wf7DG) Lean's arraignment on the new charge is scheduled for April 11.
He is free on bond and is required to submit to daily alcohol tests as a condition of his release.
