A Lolo man convicted in the November 2010 death of a pedestrian in Missoula remains free pending his appeal and an evaluation of whether he needs heart surgery.
District Judge Dusty Deschamps granted Brian Holm's petition to travel to the Mayo Clinic in Minnesota later this month for a consultation. The petition notes that if he does undergo valve replacement surgery, he would likely return by Dec. 10.
Holm was convicted last August of vehicular homicide while under the influence in the death of 24-year-old Brian Beaver of Aberdeen, Wash., and sentenced to 15 years in prison. Deschamps allowed Holm to remain free pending appeal.
The Supreme Court extended the time Holm had to file his appeal and the state has been granted several extensions due to the attorney's workload.
