A Missoula judge following an order by the Montana Supreme Court has re-sentenced a transient convicted of stabbing an employee at a homeless shelter.
Judge Karen Townsend issued a new sentence to 75-year-old John Briscoe of 20 years in prison with five years suspended. That replaces the previous sentence of 20 years in prison.
Briscoe was convicted of assault with a weapon for stabbing a Poverello Center employee in the back on June 28, 2010.
The Supreme Court ruled in July that Townsend erred in the original sentence in saying she determined the sentence because of Briscoe's lack of remorse, without stating the reasons she believed he lacked remorse.
