Prosecutors have filed a deliberate homicide charge against a 47-year-old man suspected of stomping on the head of a Billings man who died three weeks after the attack.
Eldon Otter Little Elk appeared before District Judge Susan Watters Thursday and pleaded not guilty to the charge filed after the death of 23-year-old Andrew Stoll.
Little Elk initially was charged with aggravated assault after a witness reported Little Elk stomped on Stoll's head at least twice. The charge was upgraded after Stoll died Sunday.
Little Elk remains jailed with bail set at $100,000.
