BUTTE, Mont. -

A 65-year-old Butte man has denied a vehicular homicide charge filed after a pedestrian who was struck by a pickup truck died of his injuries.

Jack Lean pleaded not guilty to the felony charge Thursday during a hearing before District Judge Brad Newman.

Prosecutors allege Lean was intoxicated on March 3 when he hit an 80-year-old man with his pickup. Thomas Kelly remained hospitalized until he died of his injuries on March 21.

Court records say Lean's blood-alcohol level was 0.12 percent, which is above the legal limit of 0.08 percent.
